WAIVER: By submitting this form you agree to the following: As parent/guardian I release above named child to participate in the Battlebasketball program. I release Battlebasketball /agents from any liability for injury resulting from participation. I firmly agree that my child is in good physical condition and with no disability, impairment, or ailment preventing participation in Battlebasketball’s fitness and sports program. I am acquainted with the danger of physical stress, strain, or injury and I accept full responsibility for my team’s use of any and all apparatus, appliances, facilities, privileges, or service whatsoever, owned and operated by Battlebasketball at my own risk and shall hold this organization, its directors, offices, employees, representative and agents harmless from any and all loss, claim, injury, damage, or liability sustained or incurred by me or my property resulting there from. I agree to abide by and uphold Battlebasketball’s rules, policies, and procedures, including to but not limited to the Battlebasketball’s Code of Conduct, to respect the decisions of the coaches and officials made in the course of performing their duties and to assume full responsibility that the child I am registering and all of our family members and guests do the same. I acknowledge that if I fail to do so, the child I am registering fails to do so, or any of our family members and guests fail to do so, I, the child and/or, any of our family members of guests may be removed and barred from any and all Battlebasketball practices and events, that the child I am registering may be removed from the Battlebasketball program, that I may be barred from registering children for any future Battlebasketball activities and the child I am registering may be barred from registering for any future Battlebasketball activities. I also agree the Battlebasketball’s dispute resolution and arbitration procedures are the sole and exclusive means for finally resolving any and all disputes with Battlebasketball, including, but not limited to claims arising out of federal and state discrimination laws. I understand and I am giving up any right I might otherwise have to present disputes to a court and receive protections available in traditional court proceedings. I also understand that if I decide to terminate my participation in the Battlebasketball program that I forfeit all monies that I have donated to the program as no refunds are given. I will also return all equipment and gear, including but not limited to Battlebasketball/Team Battle uniforms. In addition I will reimburse Battlebasketball for any unreturned equipment/gear. Furthermore, I consent to and understand that at anytime throughout the course of Battlebasketball clinics, games, or events, photographs may be taken of participants and used for promotional purpose to advertise Battlebasketball’s sports and fitness programs
